Terms of Service

Last updated: October 5, 2026

Overview

Welcome to Mekanakana.

The terms “Mekanakana,” “we,” “us,” and “our” refer to Mekanakana, a sole proprietorship operating in Ontario, Canada.

We operate this website and online store, including the information, content, products, tools, features, and services made available through it (collectively, the “Services”).

Our store is powered by Shopify, which provides the ecommerce platform that allows us to offer our products and Services to you.

These Terms of Service (“Terms”) govern your use of our website and Services and any purchases made from Mekanakana.

By accessing our website, using our Services, or placing an order, you agree to these Terms together with our other applicable policies, including our Refund Policy, Shipping Policy, and Privacy Policy.

If you do not agree with these Terms, you should not use our Services.

Nothing in these Terms limits or excludes any rights or remedies available to you under applicable consumer-protection laws that cannot legally be waived.

1. Eligibility and Use of the Services

By using our Services, you confirm that you have reached the age of majority in your province, territory, state, or country of residence, or that you are using the Services with the permission and supervision of a parent or legal guardian where appropriate.

You agree to provide accurate, current, and complete information when placing an order or creating an account.

You are responsible for maintaining the confidentiality of any account credentials associated with your use of the Services.

You may use our website and Services only for lawful purposes and in accordance with these Terms.

2. Our Products

Mekanakana creates and sells handmade, handcrafted, printed, engraved, painted, assembled, customized, and other decorative and gift products.

We make reasonable efforts to accurately represent our products through descriptions, photographs, measurements, and other information.

However, products may appear slightly different in person because of factors including screen settings, lighting, photography, materials, manufacturing processes, and the handmade nature of our work.

Natural Materials

Many of our products are made from natural materials, including wood.

Natural characteristics such as:

  • grain pattern,
  • colour variation,
  • knots,
  • texture,
  • mineral streaking,
  • small dimensional differences, and
  • other naturally occurring variations

are part of the material and are not considered defects.

No two pieces of natural wood will be exactly identical.

Handmade products may also contain minor differences from one piece to another as a result of how they are made, finished, painted, printed, engraved, or assembled.

We consider these variations part of the character of handmade products.

3. Product Availability

Products may be offered in limited quantities and may be changed, discontinued, or removed from the store at any time.

We may limit the quantities of products available to a customer, household, geographic area, or order where reasonably necessary.

Product availability is not guaranteed until an order has been accepted and processed.

4. Orders

When you submit an order, you are making an offer to purchase the products shown in your order.

We reserve the right to accept, decline, limit, or cancel an order where reasonably necessary, including because of:

  • product availability,
  • pricing or listing errors,
  • suspected fraud,
  • payment issues,
  • shipping limitations,
  • technical errors, or
  • other circumstances affecting our ability to complete the order.

If we cancel an order after payment has been received, we will refund the applicable amount.

Please review your order carefully before submitting it.

Your order is also subject to our Refund Policy and Shipping Policy.

5. Custom and Personalized Orders

Custom and personalized products may require additional information, consultation, design work, or approval before production begins.

Where we provide a proof, mockup, layout, design, or other approval document, you are responsible for reviewing it carefully.

This includes checking:

  • spelling,
  • names,
  • dates,
  • wording,
  • images,
  • artwork,
  • colours where applicable,
  • positioning, and
  • overall layout.

Once you approve a proof or mockup and production begins, the order cannot normally be cancelled, returned, or exchanged except where required by law or where Mekanakana has made an error or the item is damaged or defective.

We are not responsible for errors contained in an approved proof that accurately reflects the information or instructions you supplied.

6. Customer-Supplied Artwork and Content

You may provide us with logos, photographs, images, text, sayings, artwork, designs, trademarks, or other materials for use in custom or personalized products.

By providing these materials to us, you represent and warrant that:

you own the materials or have the necessary permission, licence, consent, or other legal authority to allow us to reproduce and use them for your order.

You remain responsible for the content you provide.

You must not provide material that infringes the copyright, trademark, privacy, publicity, personality, or other rights of another person or organization.

To the extent permitted by applicable law, you agree to indemnify and hold Mekanakana harmless from third-party claims, losses, liabilities, costs, or expenses arising from materials that you supplied and instructed us to reproduce or use.

We reserve the right to decline custom work containing material we reasonably believe may be unlawful, infringing, hateful, abusive, discriminatory, defamatory, or otherwise inappropriate.

7. Pop-Out Kits and DIY Products

Some Mekanakana products are intended for customer assembly, painting, decorating, or other DIY use.

Our Pop-Out Kits and similar products may contain small parts, glue, paint, ribbon, beads, twine, wooden components, and other craft materials.

Children should use these products with appropriate adult supervision.

Parents and guardians are responsible for determining whether a product is suitable for a child based on the child’s age, abilities, and the components included.

Products should be used only for their intended purpose.

Pop-Out Kits are subject to the return restrictions described in our Refund Policy.

8. Prices and Payment

Prices shown on our website are subject to change without notice.

The price charged will normally be the price displayed at the time your order is submitted.

Unless otherwise stated, prices may not include:

  • applicable sales taxes,
  • shipping charges,
  • customs duties,
  • import taxes,
  • brokerage fees, or
  • other charges imposed by carriers or government authorities.

Applicable amounts will be shown at checkout where Shopify and our payment systems are able to calculate them.

You agree to provide accurate billing and payment information and confirm that you are authorized to use the payment method submitted.

9. Taxes

Mekanakana is registered for GST/HST in Canada.

GST/HST Registration Number: 78373 9600 RT0001

Applicable taxes will be charged where required by law.

Customers purchasing outside Canada may also be responsible for taxes, duties, tariffs, customs fees, brokerage charges, or similar amounts imposed by their destination country or carrier.

10. Shipping and Delivery

Orders are shipped in accordance with our Shipping Policy.

Standard products are generally processed within the timeframe stated in that policy.

Custom and personalized products may require additional production time, which we will discuss with you before work begins where appropriate.

Delivery times provided by Mekanakana or a carrier are estimates and are not guaranteed.

Shipping delays may occur because of weather, customs, carrier disruptions, peak periods, labour disruptions, incorrect addresses, or other circumstances outside our reasonable control.

We will work with customers and carriers to investigate missing, delayed, lost, or damaged shipments to the best of our ability.

Additional information regarding shipping estimates, tracking, lost parcels, incorrect addresses, international shipments, and duties is available in our Shipping Policy.

11. Returns, Refunds and Cancellations

Returns, refunds, exchanges, and cancellations are governed by our Refund Policy.

Certain products, including custom or personalized items once work has begun, Pop-Out Kits, sale items, clearance items, and other products designated as final sale, may not be eligible for return or exchange except where required by law or where the product arrives damaged, defective, incomplete, or incorrect.

Customers are responsible for reviewing the Refund Policy before placing an order.

12. Wholesale and Resale

Products purchased through our standard online store are generally intended for personal or household use unless otherwise agreed.

We welcome enquiries from retailers, wholesalers, resellers, organizations, businesses, and other commercial customers interested in carrying Mekanakana products.

Wholesale, resale, volume, or commercial arrangements may be subject to separate pricing, minimum quantities, payment terms, shipping terms, and agreements.

Please contact Mekanakana directly to discuss wholesale or resale opportunities.

13. Intellectual Property

Unless otherwise indicated, the content of the Mekanakana website and Services, including our:

  • business name,
  • logos,
  • product designs,
  • original artwork,
  • photographs,
  • graphics,
  • written content,
  • product descriptions,
  • website content,
  • branding, and
  • other original materials

is owned by or licensed to Mekanakana and may be protected by Canadian and international intellectual-property laws.

You may use the website for personal, non-commercial purposes.

You may not reproduce, distribute, modify, sell, commercially exploit, republish, or create derivative works from our protected content without our written permission, except where permitted by law.

Nothing in these Terms transfers ownership of Mekanakana intellectual property to you.

Customer-supplied materials remain subject to the rights of their respective owners.

14. Third-Party Services and Links

Our Services may contain links to or integrations with third-party websites, applications, services, payment processors, shipping providers, social media platforms, or other services.

We do not control these third parties and are not responsible for their content, availability, privacy practices, security, products, or services.

Your use of third-party services may be subject to the third party’s own terms and policies.

15. Relationship with Shopify

Mekanakana is powered by Shopify, which provides the ecommerce platform used to operate our online store.

Purchases made through our store are transactions between you and Mekanakana.

Shopify provides technology and ecommerce services that support the transaction but is not the seller of Mekanakana products.

Your use of certain Shopify features may also be subject to Shopify’s own terms and privacy practices.

16. Privacy

Personal information collected through our Services is handled in accordance with our Privacy Policy.

Because our store is hosted by Shopify, Shopify and other service providers may process information necessary to operate the store, process payments, manage orders, provide analytics, prevent fraud, and deliver other services.

Please review our Privacy Policy for further information.

17. Reviews, Feedback and Submissions

If you voluntarily provide a review, testimonial, photograph, comment, suggestion, or other feedback to Mekanakana, you confirm that you have the right to provide it.

Unless you tell us otherwise, you grant Mekanakana a non-exclusive, royalty-free licence to use feedback or reviews you submit for legitimate business purposes, including displaying reviews or promoting our products.

We will not intentionally misrepresent or materially alter the meaning of your feedback.

You must not submit content that is unlawful, infringing, defamatory, abusive, misleading, or otherwise violates the rights of another person.

18. Errors and Inaccuracies

Occasionally, information on our website may contain typographical errors, inaccuracies, or omissions relating to:

  • product descriptions,
  • pricing,
  • promotions,
  • availability,
  • shipping,
  • measurements,
  • photographs, or
  • other information.

We reserve the right to correct errors and update information when discovered.

Where an error materially affects an order, we may contact you to confirm how you wish to proceed or cancel and refund the affected portion of the order where appropriate.

19. Prohibited Uses

You must not use our website or Services:

for unlawful purposes; to violate applicable laws or regulations; to infringe intellectual-property or privacy rights; to transmit malicious software; to interfere with website security; to collect personal information about others without authorization; to engage in fraud, harassment, impersonation, abuse, or misleading conduct; or to interfere with the operation of the Services.

We may restrict or terminate access where we reasonably believe these Terms have been violated.

20. Disclaimer of Warranties

We make reasonable efforts to provide accurate information and quality products.

Except for warranties or rights that cannot legally be excluded, the website and Services are provided on an “as available” basis.

We do not guarantee that the website will always operate without interruptions, errors, or technical issues.

Nothing in this section excludes statutory warranties, consumer protections, or other rights that cannot legally be excluded under applicable law.

21. Limitation of Liability

To the fullest extent permitted by applicable law, Mekanakana will not be liable for indirect, incidental, special, punitive, or consequential losses arising from use of the Services or products where such liability may lawfully be limited.

This may include loss of profits, loss of revenue, loss of data, or other indirect commercial losses.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

Nothing in these Terms limits any rights or remedies available to consumers under applicable Ontario or Canadian consumer-protection legislation that cannot legally be waived.

22. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold Mekanakana harmless from reasonable third-party claims, losses, liabilities, damages, and expenses arising directly from:

your material breach of these Terms;

your unlawful use of the Services;

your violation of another party’s rights; or

customer-supplied artwork, photographs, trademarks, logos, text, or other content that you directed us to reproduce without the necessary rights or permissions.

This section does not apply where liability arises from Mekanakana’s own negligence, misconduct, or obligations that cannot legally be excluded.

23. Termination

We may suspend or terminate access to the Services if you materially violate these Terms, engage in unlawful activity, attempt to compromise the security of the website, or otherwise misuse the Services.

Termination does not affect rights or obligations that arose before termination or provisions that are intended to survive termination.

24. Severability

If any part of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be limited or removed only to the extent necessary.

The remaining provisions will continue in effect.

25. Entire Agreement

These Terms, together with our applicable policies and any additional terms agreed to for custom, wholesale, or other special orders, form the agreement between you and Mekanakana regarding your use of the Services and purchases from us.

If separate written terms are agreed to for a particular order or commercial arrangement, those specific terms will govern that arrangement to the extent they conflict with these general Terms.

26. Governing Law

These Terms and any transactions between you and Mekanakana are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles.

Subject to any rights that consumers may have to bring proceedings in another jurisdiction under applicable law, disputes relating to these Terms or the Services will be handled in Ontario, Canada.

Nothing in this section limits any consumer rights or legal protections that cannot lawfully be waived or restricted.

27. Changes to These Terms

We may update these Terms from time to time to reflect changes to our business, products, Services, legal requirements, or operating practices.

The current version will be posted on our website with the date of the latest update.

Where required by law, we will provide additional notice of material changes.
